In consideration of participating in any activities with Walter Anderson Museum of Art (WAMA) (referred to as “the Organization”), I agree to release, waive, and hold harmless the Organization, its staff, trustees, and affiliates from any and all claims, injuries, damages, or losses (including death or disability) to myself or property, arising from my participation in activities, whether caused by my own actions, the actions of others, or risks that are known or unknown.
Acknowledgment of Risks
I understand that participating in activities at the Organization may involve risks, including but not limited to:
Use of Tools and Equipment: Risks associated with hand tools, power tools, art-making tools (such as paint, sharp objects, glass), and other equipment.
Exposure to Materials: Risks of exposure to paints, solvents, chemicals, and other materials used in art-making or other creative activities.
Physical and Environmental Risks: Risks from outdoor activities such as hiking, maritime travel, or exposure to weather conditions (heat, cold, sun, etc.), as well as risks from animals or plants.
Travel Risks: Risks associated with travel, including vehicle accidents, weather conditions, and other travel-related dangers.
Health Risks: Risks of accidents, injury, or illness (including contagious diseases like COVID-19) during participation in activities.
Photography and Videography: I consent to being photographed, filmed, or recorded during activities for educational or promotional purposes, with no further need for permission or compensation. If I do not wish for my or my child/ward’s image to be used, I will notify the staff before the event.
Assumption of Risks
I recognize that participation in these activities is voluntary and involves substantial risks, including injury, death, or property damage. I accept full responsibility for all risks related to my participation or that of my child/ward, and for any costs resulting from injury or property damage.
Medical and Emergency Information
I certify that I, or my child/ward, am/is in good health and have no physical limitations that would affect my ability to safely participate in the activities. I am responsible for any medical expenses incurred as a result of my participation, and I understand that the Organization is not responsible for these costs.
Compliance with Safety Guidelines
I agree to follow all safety instructions provided by the Organization, including any health and safety protocols related to communicable diseases like COVID-19. If I or my child/ward experience symptoms of illness or have been exposed to any contagious disease, I will notify staff immediately.
Release and Indemnification
I release and hold harmless the Organization, its staff, and affiliates from any liability, and agree to indemnify the Organization for any claims or damages arising from my participation or that of my child/ward.
Behavior Clause
At the museum, we ask all visitors to be respectful and follow the rules. Please be kind to staff, other guests, and the exhibits. If your behavior is disruptive or harmful and cannot be corrected, you may be asked to leave without a refund. We want everyone to have a safe and enjoyable experience.
Agreement to Terms
By signing below, I confirm that I have read and understood this waiver, and I agree to all terms and conditions. I understand that this agreement is intended to be as broad as allowed by law. If any part of this agreement is found to be invalid, the rest will still apply.
